Terms of Sale for Trailsift Pro

These terms apply when you buy Trailsift Pro, made by Itch Studio Ltd. (“us”, “we”, or “our”). Using the Trailsift app (the “App”) is also covered by our App Terms of Use; where the two differ about a purchase, these terms apply. Nothing in these terms affects your legal rights as a consumer.

1. What You Are Buying

The App is free to download and use for its audit of the places macOS lets any app read. Trailsift Pro is a one-time purchase that unlocks the features marked Pro in the App and on our website when you buy. It is not a subscription: you pay once, and nothing renews.

We grant you a personal licence to use Pro on the Macs you own or control. We don't count or limit them. You may not share, sell or publish your licence key.

2. Who Sells It

Pro is sold through Link, Stripe's merchant of record service. Link is the seller: it takes your payment, charges any VAT or sales tax due where you live, sends your receipt and invoice, and can help with payment questions. Your card statement shows LINK.COM followed by our name. Your payment is also covered by Link's terms for purchases sold through Link. The licence, the App and support for it come from us.

3. Price and Payment

The price is £15, $19 or €17, or the equivalent shown at checkout in your currency, and includes any VAT or sales tax. Payment is taken when you place the order. We never see or store your card details.

4. Delivery

Your licence key is emailed to you as soon as payment is confirmed. Copy it into Trailsift with Enter Licence. It is checked on your Mac, without going online, and works on each of your Macs. If it hasn't arrived within an hour, check your junk mail, then use the resend form on our website or contact us.

5. Refunds

If you change your mind, email support@trailsift.com within 14 days of buying, from the address you bought with, and we will refund you in full. You don't need to give a reason. The refund goes back to the way you paid, normally within 5 to 10 days. You can also ask Link for a refund through its support pages. After a refund, please stop using the licence key.

This covers your 14-day right to cancel under the Consumer Contracts Regulations 2013, so you are not asked to give it up when you buy.

After 14 days, your rights under the Consumer Rights Act 2015 still apply: Pro must be as described, fit for purpose and of satisfactory quality. If it isn't, tell us and we will fix it, or, if we can't do that within a reasonable time, refund you.

6. Updates

Your purchase includes the updates we release for the version you bought. If we ever release a new major version as a separate purchase, we will say so clearly before you buy it, and the version you already have will keep working.

7. Clearing Traces

Pro can delete traces you select. Before anything is removed, the App shows what will be deleted and asks you to confirm. Deleting is permanent: removed items cannot be brought back by us or by the App. Back up your Mac, for example with Time Machine, before clearing anything you might want later.

Trailsift shows where traces are kept, and it can't see everything: some apps keep their own records, and copies can exist on other devices, in backups and with online services. It isn't a forensic tool, and a clean report is not a guarantee that no data remains.

8. Our Responsibility to You

If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that, but not for loss or damage that isn't foreseeable. We are not responsible for data you choose to delete with the App after confirming it.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

If you buy Pro for a business, we are not liable for loss of profit, business or data, and our total liability to you is limited to the price you paid.

9. Changes to These Terms

We may update these terms. The terms that apply to your purchase are the ones published when you bought.

10. Governing Law

These terms are governed by the law of England and Wales. If you are a consumer, you can bring a claim in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts there.
